When enrolling or booking a DOGA session you agree to the following terms and conditions:
This DOGA Class Services Agreement ("Agreement") is entered into between Pet Valet, Inc. ("Pet Valet") and "Client," who is the recipient of these terms and the invoice for booking the DOGA session.Client desires to engage Pet Valet to provide a DOGA session, class, or workshop, in which the client will attend with or without a dog, at a specified location (the "Services").
Payment. At the time of booking, Client shall pay Pet Valet the amount ("Payment") for the Services, as invoiced by Pet Valet. Any additional fees or expenses incurred by Pet Valet that are not included in the initial Payment shall be billed to Client and paid within 30 days of the invoice date. Failure to pay any amount due under this Agreement may result in the suspension or termination of the Services.
Liability Limitation. Client acknowledges and agrees that Pet Valet shall not be liable for any indirect damages arising out of or in connection with the Services, including but not limited to any injuries or damages caused by their dogs. In no event shall Pet Valet's liability exceed the amount paid by the Client for the Services.
Indemnification. Client agrees to indemnify and hold Pet Valet, its officers, directors, employees, agents, and affiliates, harmless from any and all claims, damages, and expenses arising out of Client’s or their dog’s behavior or actions, particularly injuries or damages caused or suffered by their dogs. Each attendee is fully responsible for any damages or injuries caused by their dogs.Dog's Health and Behavior. Client represents and warrants that the Dog is in good health and has current vaccinations. Client agrees to provide proof of current vaccinations upon request. Client further represents and warrants that the Dog does not have any history of aggressive behavior towards people or other dogs. Pet Valet reserves the right to refuse Services if the Dog's health or behavior is in question. Each attendee is responsible for ensuring that their dog is leashed at all times and under their control during the Services.
Cancellation and Rescheduling. Provided that cancellation is made at least 24 hours prior to the session, participants may use the booking for any other class within the same month. Failure to notify the company in advance may result in forfeiting the spot without a refund or credit. The company reserves the right to make exceptions to this policy in extenuating circumstances, such as illness or emergencies.
Taxes. Client shall be responsible for any and all sales, use, excise, value-added, or similar taxes arising out of or in connection with the Services. If Pet Valet is required by law to collect such taxes, they will be invoiced to Client and paid by Client in addition to the Payment for the Services.
Nature of Services. The DOGA session, class or workshop is intended to provide attendees with an opportunity to bond with their dogs and the community, and is not intended to be a comprehensive yoga class or a dog training class. Attendees shall be reasonable and perform the exercises to the extent they and their dogs will feel comfortable. The instructor is not aware of the health and behavior of attendees and their dogs, and therefore each attendee shall be responsible for judging what exercises they and their dogs can safely perform.
Governing Law and Jurisdiction. This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law provisions. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought exclusively in the courts of the State of New York located in New York County, and each party hereby consents to the jurisdiction of such courts for such purpose.
By engaging Pet Valet to provide the Services and making the Payment,Client acknowledges and agrees to the terms and conditions of this Agreement. Client further acknowledges and agrees that they have read and understood the terms and conditions of this Agreement and have had the opportunity to ask questions and seek legal advice prior to entering into this Agreement.
